By using these services, you agree to the following Terms and Conditions in relation to your use of the CrowdRoaming App (“the App”) provided by DASHT BV (“DASHT”), a Dutch Company.

These Terms and Conditions include DASHT’s Privacy Policy, which explains how we collect and process information about you for the purposes of our App.

It also includes our End-User License Agreement, which is a contract stating your rights and obligations in relation to the App.

If you do not agree to any of the below, either by refusing to give consent to the ways we collect and process information about you in our Privacy Policy, or if you refuse to be bound by our EULA, then you are not permitted to use the App. We kindly request you to uninstall it from your mobile device.

Privacy Policy

Your privacy is important to DASHT. This Privacy Policy explains what personal information DASHT collects about you and what we do with that information. It applies to all the services that DASHT provides, including the App, our website, and any other service provided now or in the future (“the Services”).

What personal information does DASHT collect?

Information you give us: For example, our Services may require you to sign up for an account, either directly through us, or via third party websites (eg. social networks like Facebook). When you do, you provide us with personal information such as your name, email address or telephone number. You may also grant us access to third party services (for example, your email account) or to use your social networking information if you give us access to your account on social network connection services. We will only use this information according to the Purposes explained in this policy.

Information you give us via Facebook: If you choose to register for our Services through Facebook, we may collect the following information:

Facebook login Information. We will ask you to log into your Facebook account through our Services. Facebook controls the information collected from you during the log in process. DASHT does not control the information that Facebook collects from you. We do not save or otherwise have access to any of your Facebook login information.

Information that we collect about you from Facebook. When you sign into Facebook through our Services, we may request your permission to access your basic information, including, your name, profile picture, list of friends, email address, and any information you have set to ‘public’ on your Facebook account; send email directly to you; post to your Wall; and access your data at any time even if you are not using Facebook. Please note, if you allow our Services to have access to this information, then we will have access to this information even if you have chosen not to make that information public. For information about how Facebook may disclose your information, including any information you make public, please consult the Facebook Privacy Policy and Facebook Permissions Documentation.

Information we collect: When you use our Services, we automatically record information from your device, its software, and your activity using the Services. This may include the device’s Internet Protocol (“IP”) address, your mobile carrier, date and time stamps associated with your use of the Services, system configuration information and other interactions with the Services. We may also collect anonymous crash and usage statistics to help us debug and improve our Services.

Other information: We may also collect personal contact information and correspondence via our web sites and communications channels, which allows us to offer user support, beta testing communities, surveys, and similar services.

Your choice: We have worked hard to limit the amount of personal information we gather to only those data required in order for our Services and business model to function. However, it is up to you to give consent whether to provide the above-described personal information through the Services.

If you do not agree to provide some of these information when requested (sometimes, on a case-by-case basis), DASHT may not be able to provide certain services to you and some services may be unable to work.

What does DASHT do with your personal information?

The personal information DASHT gathers is used to (‘purposes’):
• Personalize your experience of our Services
• Improve the quality of our Services
• Interact with external social-networks (eg. Facebook)
• Analytics, (usage patterns, crash reports)
• Traffic optimization and distribution
• Handling payments
• Interact in order to provide feedback and support requests
• Help to identify bugs and software design flaws.

In the context of analytics and quality assurance, all data harvested by DASHT is processed according to ‘App instance’ rather than by accounts or user device numbers.

WITHOUT YOUR AFFIRMATIVE CONSENT (ON A CASE-BY-CASE BASIS), WE DO NOT SELL, RENT OR OTHERWISE SHARE YOUR PERSONALLY IDENTIFIABLE INFORMATION WITH OTHER THIRD PARTIES, UNLESS OTHERWISE REQUIRED TO BY LAW. TO THE EXTENT WE SHARE INFORMATION WITH OUR PARTNERS AND ADVERTISERS, WE SHARE ONLY AGGREGATED OR OTHERWISE NON-PERSONALLY IDENTIFIABLE INFORMATION THAT IS NOT LINKED TO YOUR PERSONALLY IDENTIFIABLE INFORMATION.

How long do we preserve your personal information?

Conservation Time: the personal information we collect from you are kept for the time necessary to perform the Services requested by you. You may at any time, request its rectification or removal.

If you request for your account to be deleted, all your personally identifiable information will be erased within a commercially reasonable time.

Transfer of personal information: In so far as DASHT will make use of cloud storage providers to store your personal information, such cloud providers will be resident in the EU only and thus subject to EU data protection law.

BY CONTINUING TO USE OUR SERVICES, YOU EXPRESSLY AND UNAMBIGUOUSLY CONSENT TO SUCH TRANSFER OF PERSONAL INFORMATION.

Data security

DASHT uses commercially reasonable and appropriate physical, managerial, and technical safeguards to preserve the integrity and security of your personal information. For example, DASHT uses Virtual Private Network (“VPN”) technology with end-to-end data encryption to provide the services of its App.

However, DASHT cannot ensure or warrant the security of any information you transmit to DASHT and you do so at your own risk. Once we receive your transmission of information, DASHT makes commercially reasonable efforts to ensure the security of our systems. However, please note that this is not a guarantee that such information may not be accessed, disclosed, altered, or destroyed by breach of any of our physical, technical, or managerial safeguards. If DASHT learns of a security systems breach, then we shall attempt to notify you electronically so that you can take appropriate protective steps. DASHT may post a notice on the DASHT Site or through the DASHT Service if a security breach occurs.

What information isn’t covered by this privacy Policy?

This privacy notice does not extend to anything that is inherent in the operation of the Internet or telecommunications networks or is beyond the control of DASHT, and is not to be applied in any manner contrary to applicable laws, rules or regulations.

Notices, access and revisions

DASHT may, without prior notice to you, occasionally update this privacy policy. Revisions will be posted to the website www.crowdroaming.com

You may also at any time request to view and/or have removed and rectified any personal information DASHT has stored on you by contacting info@crowdroaming.com


 

End-User license Agreement

License grant: DASHT grants you a world-wide, nonexclusive, royalty-free, non-transferable, non-assignable, license, without the right to sub-license, under all its relevant intellectual property rights to use the App according to the terms of this EULA.

This License Grant refers only to the DASHT proprietary components of the App and proprietary components licensed from third parties to which DASHT has acquired rights to, including the right to sub-license. All Open Source Software components are licensed according to the section “Open Source Software” below.

Restrictions: You may not sub-license, sell or lease the App software to any third parties. You also agree not to reverse engineer, decompile, disassemble or otherwise attempt to reconstruct, identify or discover any source code, underlying ideas or algorithms embodied in the proprietary components of the App software.

Term and Termination: the license grant starts when you indicate your agreement to be bound by the terms of this EULA by clicking “Accept”. It shall remain in force until terminated. On termination, you will lose all rights to the continued use of the App.

Open Source Software: The App contains software components which are covered by open source licenses. These components are licensed according to their applicable open source licensing terms in lieu of the terms in this EULA. Please visit our website www.crowdroaming.com/ for the full text of these open source licenses.

No Warranties: The App software is provided “AS IS”, EXCLUDING ANY AND ALL OTHER WARRANTIES, EXPRESS AND IMPLIED, INCLUDING BUT NOT LIMITED TO ANY IMPLIED WAR¬RANTIES OF EMERGENT ABILITY, NON-INFRINGEMENT, MERCHANTABILITY AND/OR FITNESS FOR A PARTICULAR PURPOSE.

Limitation of Liability: IN NO EVENT SHALL DASHT BE SUBJECT TO ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES UNDER THIS AGREEMENT, EVEN WHERE IT HAS BEEN ADVISED OF SUCH DAMAGES BEING A POSSIBILITY.

FURTHERMORE, DASHT HEREBY DISCLAIMS ALL LIABILITY FOR YOUR USE OF THE SERVICES WHICH MAY RESULT IN ANY TORT OR BREACH OF CONTRACT BETWEEN YOURSELF AND ANY OTHER THIRD PARTY. YOU EXPRESSLY ACKNOWLEDGE THAT YOUR USE OF THE SERVICES IS YOUR CHOICE AND THAT DASHT IN NO WAY INDUCES YOU TO COMMIT ANY BREACH OF AN AGREEMENT WHICH MAY EXIST BETWEEN YOU AND ANY OTHER THIRD PARTY.

No Waiver: Neither the failure nor the delay of either party to enforce any provision of this Agreement shall constitute a waiver of such provisions or of the right of either party to enforce each and every provision of this Agreement.

Miscellaneous: You acknowledge that standard fees of your mobile network carrier may apply to your use of the App, including, but not limited to, any extra fees you may incur from exceeding the agreed limits of your data bundle.

This Agreement shall be governed by and construed in accordance with the laws of the Netherlands.
